De acordo com a Lei Complementar 150 de 1°de junho de
2015, é considerado empregado doméstico aquele que
presta serviços de forma contínua, subordinada, onerosa
e pessoal à pessoa ou à família no âmbito residencial
destas.
Outra questão importante a ser observado nesta lei é
saber a partir de qual frequência semanal cria-se o
vínculo trabalhista.
Para esta finalidade, por mais de 2(dois) dias na semana
aplica-se a legislação trabalhista.
Também é importante observar que a duração normal do
trabalho doméstico não pode ultrapassar 8 (oito) horas
diárias e 44(quarenta e quatro) semanais, caso contrário
será considerado hora extraordinária.
